Propery Offence Definitions (1)

Definitons of all the property offences for unit 4 of the exam. These include: theft, robbery, burglary, fraud, making off without payment, criminal damage.

Theft
Theft is defined in s.1 of the Theft Act 1968 ‘A person is guilty of theft if he dishonestly appropriates property belonging to another with the intention of permanently depriving the other of it.’

Robbery
Robbery is defined in s.8 of the Theft Act 1968 ‘A person is guilty of robbery if he steals, and immediately before or at the time of doing so, he uses force on any person or puts or seeks to put any person in fear of being subjected to force.’

Burglary is defined in the Theft Act 1968. According to s.9(1), ‘ a person is guilty of burglary if:

Making of without payment is defined in s.3 of the Theft Act 1978 as ‘ a person who knowing that payment on the spot for any goods supplied or service done is required or expected from him, dishonestly makes off without having paid as required or exp

Fraud
Fraud by false representation is defined in s.2 of the Fraud Act 2006 ‘ a person dishonestly makes a false representation, in order to gain for himself or another, or cause or expose another to loss or risk of loss.

Criminal damage is defined under s.1 of the Criminal Damage Act (1971) as ‘A person without lawful excuse destroys or damages any property, belonging to another, intending to destroy or being reckless as to whether property is being destroyed or dam
