must be fair and require consistency so it can lead to public confidence.

what is retrobution about?
it meets with the publics approval. and the defendant cant be released even if no longer a danger to society.

what is deterance about?
its about individual and general levels. general levels stop all society from doing things should as stealing.

what is protection about?
it protects the piblic and the prisoners cant reoffend if they are in prison. however it can be negative because when they leave they become unemployed and unemployability leads to return to crime.

what is rehabilitation about?
it overcomes problems , and avoids from reoffending. and it also intergrates people back to society.

what are the types of sentencing?
custodial. community. financial. discharge. other.

what is custodial about?
prison. s225 states if the convict is 18+ and has committed a serious offence or is a rsik to the public the it must be a custodial sentence.

what is a community sentence?
the state may give out a community rehabilitation order as an order of probation. this could last from 6 months to 3 years. the punishment order for community orders are of 240 hours. another could be that they make a cerfew , or a programme requirme

what is a financial sentence?
most common. they can fine up to certain limits but have to take means. for example , they cant give out a £100,000 fine to some on benefits. fines are imposed on 3/4 of motoring offences tried summarily.

what are the agrivating factors?
previous convictions. racial or religious beliefs. vulnerable victims. gang attacks. use of weapons. these give out more serious sentences.

what are the mitigating factors?
first offence. age. vulnerabe. remorse. circumstances. guilty plea
