IT and the Law: Part 1

Intellectual Property (IP)

  • Modern IT makes unauthorised copying + distribution IP easy + cheap - illegal copying music, software + films widespread.
  • Companies/individuals depend income creative products seek ways countering threat their businesses.

Copyright Designs + Patents Act 1988

  • Covers protection all forms 'intellectual property' i.e. publications, broadcasts + music well software (70 years + 50 years) + US 95 years.
  • 'Digital righst management' DRM) used prevent copying films, music etc.

Software Piracy

  • Definition: 'The unauthorised use/illegal copying computer software. This can take many forms e.g. commercial counterfeiting, deliberate + unauthorised copying dealers, unlicensed copying + use by end users + plagiarism by competitors.'
  • Software licensed, not owned - rights use, reproduce + distribute software specified license.

  • FAST (Federation Against Software Theft)
  • FACT (Federation Against Copyright Theft)
  • Software Alliance 
  • SIIA (Software + Information Industry Association)

Privacy and Data Protection Act

  • Data Protection Act 1984, Access Personal Files Act 1987.
  • Data Protection Act 1998 (EU Data Protection Directive 1995)
  • Data Protection Act 2018
  • Enforcement: Information Commissioner's enforcement powers set out Act. Include serve info + assessment notices + enter + inspect premises certain circumstances.

  • Consents must granular.
  • Consent must freely given.
  • Consents must as easily withdrawn as given.
  • Consents must securely store legal documentation.
  • Consent must renewed least 1 per year.
