Negotiation

Advantages

  • Only involves parties themselves- no lawyers
  • Can happen anytime- while preparing case for court so no wasting time
  • Cheapest method
  • Outcome is confidential and private
  • Relationships maintained

Disadvantages

  • Not successful if parties not talking- might need other methods of ADR or court
  • Loads of failed attempts= waste of time and money
  • Big businesses not take individuals seriously
  • Cost if lawyers used
  • Absence of neutral third party can result in parties being able to reach an agreement- imbalance of power

Evaluation

Most private, quick and cheapest method of settling a dispute. Can be face to face, by email or telephone. Involves communication between both parties until the matter is resolved or process fails. A successful outcome is an agreement between the two parties- enforceable in a court of law if parties reach a formal agreement
