Delegated Legislation + and -

Advantages

  • Its quicker then parliament; as they can be passed within a short amount of time.
  • Allows Parliament to concentrate on broader issues
  • Allows for specialized and local knowledge to be used; making them more effective then laws
  • easily revoked if problems caused; where as laws need other laws to revoke them
  • impossible for parliament to see problems when passing the act; delegated legislation allows for changes and updates to be made; I.E minimum wage
  • Allows for rapid action in emergencies (Foot and Mouth crisis)

Disadvantages

  • In some cases it is undemocratic
  • There is a risk of sub-delegation; such as government ministers may pass it onto someone in their department to complete
  • Large amount publicized; for statutory instruments there are over 3000+ made each year
  • A lack of publicity- mainly online. Unable to access a majority through libraries.
  • The control by parliament is not always effective; time consuming
  • Lack of scrutiny.
